Prosecutor still to file charges

Attorney awaits medical reports before beating case goes to court

Charges are pending for five Ball State University affiliated women who supposedly beat an Ivy Tech student at an off-campus party in October, officials said.

Delaware County deputy prosecuting attorney Judi Calhoun said she is awaiting further information about the extent of the victim's injuries before filing charges.

As it stands, Calhoun said she is deciding between two charges to file: aggravated battery, a Class B felony, and battery resulting in serious bodily injury, a Class C felony,

If convicted, the Class B felony has a potential prison term of between six and 20 years and a maximum fine of $10,000. The Class C felony has a potential prison term of two to eight years if convicted.

In order to charge the accused of aggravated battery, Calhoun said, she needs to prove that the injury caused prolonged loss of use of the injured body part, which is why she said she is waiting for the most recent medical reports.

Detective Jami Brown of the Muncie Police Department said in a prior interview the victim was taken to Ball Memorial Hospital with severe injuries to her right arm, which resulted in a surgery.

Calhoun said a large number of witnesses has also contributed to the delay in filing charges.

Retrieving statements from the 10 to 15 witnesses who are involved in the case has added to the delay in filing charges, Calhoun said.

Calls made to the suspects went unanswered late Tuesday afternoon.
